Waste Management Permit Regulations
Under the Waste Management Act, 1996 , and most recently the Waste Management (Facility Permit & Registration) Regulations 2007 (as amended in 2008), all waste activities must have either a waste licence from the Environmental Protection Agency (EPA) or a waste permit/certificate of registration from the relevant local authority.
Activities that need a permit/certificate of registration, as detailed in the Waste Management (Permit) Regulations, include recycling and recovery facilities, car dismantling facilities and disposal facilities where the annual intake is less than 5,000 tonnes (excluding hazardous waste and landfills).
Activities requiring a permit /cert of registration are generally smaller scale activities with low environmental risk. Applications for permits and all associated information are available for inspection at the prinicpal office of Cork County Council's Environment Department, Inniscarra.
When an operator applies for a waste permit, any person can make a written submission in relation to an application within 25 working days of date application is made available for public inpsection. Cork County Council will not grant a permit unless satisfied that:
- The activity will not cause environmental pollution.
- Emissions will not contravene relevant standards or emission limit values.
- Best technology, which does not entail excessive cost, will be used.

Where and How to Apply
All applications in respect of waste management activities requiring a permit or certificate of registration must be made on the official application form. Applications must be accompanied by the following information:
- Completed application form.
- Copy of newspaper advertisement. (waste permits applications only)
- Copy of site notice. (waste permits applications only)
- Site plan, showing the location of the site notice, emission points and sampling points.
- Location map.
- Appropriate application fee -- see schedule attached to application form.

Register of Waste Management Permits
Cork County Council maintains information on permitted waste collectors for Cork City and County, in line with the requirements of the Waste Management (Register) Regulations, 1997. Please contact the Environment Department, Cork County Council on (021) 453 2700 for details of these facilities.
Obligations on Holders of Waste Management Permits
Waste management permit/cert holders must furnish the nominated local authority annually with an Annual Environmental Return (AER), summarising their activities for the preceding year, in such format as may be specified by the authority.
Please note that failure to submit the required information may result in prosecution and/or revocation of permits. The deadline for submission is the end of February each year.

Cork County Council intends carries out compliance auditing on an ongoing basis in relation to waste permit/certicate conditions. Please ensure that both you and your employees are fully aware of the conditions attaching to your waste permit /certificate and take any corrective actions necessary prior to audit.
