(In accordance with Section 75 of Roads Act, 1993 & Part V111 of Roads Regulations, 1994) Application Form TRCA
Kinsale Town Council, being the Roads Authority for the urban area of Kinsale, will consider applications from organisations and persons for the temporary closure of public roads (Section 75 of the Roads Act, 1993).
Application Forms are available from the Town Clerk, Kinsale Town Council, Municipal Hall, Kinsale, Co. Cork
Completed Application Forms must be received in the relevant office at least 4/5 weeks in advance of proposed closure. Completed Application should include description of road to be closed, road numbers (if known to applicant) date of proposed closure, time of proposed closure and copy of Insurance policy document. Kinsale Town Council must be specifically indemnified for €6.4 million.
If the space available on Application Form is insufficient for road description details (e.g. for car rallies) further information can be submitted on additional sheet.
A Safety Plan must be submitted outlining how the event will be marshalled to ensure the safety of all participants and spectators attending the event.
Upon receipt of completed Application, the Council must proceed to publish First Public Notice, which advises the public of the intent to close a certain road or roads for a specific time. In that First Public Notice, the general public are given at least 3 days in which to submit observations or objections to the proposed closure following publication.
If any observations/objections are received, the applicant will be contacted regarding observations/objections seeking resolution by the applicant of issued raised.
Once issues raised have been resolved and the Town Clerk has approved the application, the Town Council must proceed to publish a second public notice informing the public that the Council is proceeding with the road closure. This must be published at a minimum 7 days before the event.
Any costs incurred by the Town Council when processing this application will be recouped shortly after the closure. This is normally advertising costs plus levy but may also include costs imposed for non-compliance with conditions attached to Council approval.
