PUBLIC NOTICE

PLANNING AND DEVELOPMENT ACT, 2000 (as amended) – Part XAB, SECTION 177AE and PLANNING & DEVELOPMENT REGULATIONS 2001 (as amended)

MALLOW TOWN PARK – PROPOSED IMPROVEMENT WORKS

Notice is hereby given, pursuant to the provisions of Part XAB, Section 177AE of the Planning & Development Act 2000 (as amended), that Cork County Council is applying to An Board Pleanála (“the Board”) s to undertake the following development:

The project is located at Mallow Town Park, Park Road/N72, Mallow

The proposed development is to provide improvement works to the existing Town Park and comprises:-

In the Townlands of: Mallow, Castlepark and Killetra in County Cork

  • enhancement of existing park entrances and construction of new entrances;

 

  • widening of existing footpaths from 2m to 3m and widened pedestrian bridge crossing

of the Caherduggan/Spa Glen stream;

  • construction of new footpaths;

  • reconfiguration and enhancement of existing grass playing pitches and training area;

The offices of An Bord Pleanála, 64 Marlborough Street, Dublin 1 between the hours 9:15am and 5:30pm Monday to Friday (Excluding Public Holidays)

 

  • construction of multi-use events area and jogging/ walking trail;

 

 

  • construction of 5no. angling stands on the banks of the River Blackwater;

 

 

  • redevelopment of existing playground, construction of skate plaza and pump track;

 

 

  • construction of bike and car parking areas;

 

 

  • undergrounding of existing overhead 10kV powerlines;

 

 

  • park fencing/gates; signage; drainage; furniture; planting; and,

 

 

  • All associated site development and landscaping works.

 

The proposed works are within the curtilage of a number of Protected Structures, RPS No’s 79, 120, 22, 124, 129 and 130 of the Mallow Development Plan 2010-2016 (still in effect), and are within the Architectural Conservation Area 1 for Mallow Town. Sections of the park along the River Blackwater are located within the Blackwater (Munster) Special Area of Conservation (SAC 002170).

 

The proposed works are within the Zone of Archaeological Notification of a number of Recorded Monuments, CO033-093----, CO033-094--- , CO033-009001-, CO033-009—6-, and CO033-009004, as

entered in the Record of Monuments and Places for County Cork.

 

A Natura Impact Statement has been prepared as part of the application for approval in respect of the proposed development.

 

An Bord Pleanála may give approval to the application for development with or without conditions or may refuse the application for development.

A copy of the plans and particulars of the proposed development and the Natura Impact Statement will be available for inspection free of charge, or purchased at a fee not exceeding the reasonable cost of making a copy, for a period of 6 weeks (excluding Bank Holidays) between 31st May and 13th July 2021 at the locations above.

Any submissions and observations on the proposed development in relation to –

  1. the implications of the proposed development for proper planning and sustainable development in the area concerned,
  2. the likely effects on the environment of the proposed development, and
  3. the likely significant effects of the proposed development on a European Site, if carried out, may be made in writing to An Bord Pleanála, 64 Marlborough Street, Dublin, D01 V902.

Any submission/observation must be received by An Bord Pleanála before and not later than 5.30pm on 13th July 2021.

A person may question the validity of any such decision by An Bord Pleanála by way of an application for judicial review under Order 84 of the Rules of the Superior Courts (S.I. No. 15 of 1986) in accordance with section 50 of the Planning and Development Acts, 2000 (as amended).
